1. Acceptance of Terms
By accessing or using Tarmac and Toast (“we”, “us”, or “our”) mobile application or website, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use our services.
2. Description of Service
Tarmac and Toast is a car community platform that connects car enthusiasts in South Africa. Our services include:
– Social Feed: Instagram-style feed for sharing car photos, videos, and stories
– Car Meets & Events: Discover, organize, and RSVP to car meet events
– Digital Garage: Showcase your car collection with detailed specs, modifications, and photos
– Marketplace: Buy and sell car parts, accessories, and automotive services (seller verification required)
– Car Clubs: Join, create, and manage car clubs and crews (paid tier required to join)
– Race Tracks: Find race tracks and book track events
– Businesses: Discover and connect with automotive service businesses (detailing, modifications, tinting, wraps, performance tuning)
– Challenges: Participate in community challenges, earn points, and compete on leaderboards
– Messaging: Direct messaging between users
– Track Pro: Business subscription tier for race track owners and professional venues (includes event management, analytics, verified track badge, and ability to post race results and YouTube streams)
– Business Pro: Business subscription tier for automotive service businesses (includes service listings, business profile customization, analytics, and verified business badge)
3. User Accounts
3.1 Account Registration
– You must be at least 18 years old to create an account
– You must provide accurate, current, and complete information
– You are responsible for maintaining the security of your account
– You must notify us immediately of any unauthorized use of your account
3.2 Account Responsibilities
– You are responsible for all activities that occur under your account
– You must not share your account credentials with others
– You must not create multiple accounts to circumvent restrictions
– We reserve the right to suspend or terminate accounts that violate these Terms
4. User Conduct
4.1 Prohibited Activities
You agree NOT to:
– Post false, misleading, or fraudulent information
– Sell illegal, stolen, or counterfeit items in the marketplace
– Harass, threaten, or abuse other users
– Post offensive, discriminatory, or inappropriate content
– Spam, scam, or engage in deceptive practices
– Violate any laws or regulations
– Infringe on intellectual property rights
– Interfere with the app’s functionality or security
– Use automated systems to access the service without permission
4.2 Content Standards
– All content must be legal and appropriate
– No hate speech, discrimination, or offensive material
– No personal information of others without consent
– Respect intellectual property rights
5. Marketplace Transactions
5.1 Buying and Selling
– Tarmac and Toast provides a platform for users to buy and sell car parts
– Seller Verification: Sellers must be verified before creating listings (24-48 hour review process)
– We are not a party to transactions between users
– All transactions are between buyers and sellers directly
– We do not guarantee the quality, safety, or legality of items sold
– Listing limits depend on your subscription tier (free tier: 2 listings, paid tiers: 10+ or unlimited)
5.2 Seller Responsibilities
– Sellers must accurately describe items for sale
– Sellers must deliver items as described
– Sellers are responsible for payment processing and shipping
– Sellers must comply with all applicable laws
5.3 Buyer Responsibilities
– Buyers must pay for items as agreed
– Buyers should inspect items upon receipt
– Buyers must report any issues promptly
– Buyers are responsible for verifying item condition before purchase
5.4 Disputes
– Tarmac and Toast is not responsible for resolving disputes between buyers and sellers
– Users should attempt to resolve disputes directly
– We may assist in dispute resolution but are not obligated to do so
– Users may report fraudulent activity to us
6. Subscriptions and Payments
6.1 Subscription Services
Tarmac and Toast offers the following subscription tiers:
– Street Pass (Free): Basic community access
– Garage Access (R99/month or R999/year): Enhanced features for regular members
– Crew Tier (R199/month or R1,999/year): For event organizers and crews
– Pit Lane VIP (R299/month or R2,999/year): For influencers and car clubs
– Apex Elite (R499/month or R4,999/year): Premium tier with exclusive benefits
– Track Pro (R1,499/month or R14,999/year): Business subscription for race track owners and venues
– Business Pro (R1,499/month or R14,999/year): Business subscription for automotive service businesses
General Subscription Terms:
– Subscription fees are charged according to the selected plan
– Subscriptions automatically renew unless cancelled
– Prices may change with 30 days’ notice
– Each subscription tier includes specific features and benefits as described at the time of purchase
6.2 Payment Processing
– Payments for regular subscriptions (Garage Access, Crew Tier, Pit Lane VIP, Apex Elite) are processed through Walletdoc, a secure payment gateway
– Business Pro and Track Pro subscriptions are handled via manual invoicing (contact [email protected] for payment details and invoicing)
– We do not store your full payment card information
– Payment information is securely handled by Walletdoc (for regular subscriptions)
– You agree to pay all fees associated with your subscription
– All fees are in South African Rand (ZAR) unless otherwise stated
– Subscription payments are processed automatically on your billing date (for regular subscriptions)
– Failed payments may result in subscription suspension or cancellation
6.3 Cancellation
– You may cancel your subscription at any time through the app settings
– Cancellation takes effect at the end of the current billing period
– You will retain access to premium features until the end of your paid period
– No refunds for partial billing periods (see Refund Policy)
– After cancellation, your subscription will automatically downgrade to Street Pass (free tier)
– You can resubscribe at any time
7. Events and RSVPs
7.1 Event Participation
– Users may create and attend car meet and race track events
– Event hosts can edit their events after creation (subject to admin approval for changes)
– Event organizers are responsible for event safety and legality
– Tarmac and Toast is not responsible for events organized by users
– Users attend events at their own risk
– Events may require admin approval before being visible to the community
– Track Pro users can create race track events, post race results, and share YouTube live streams
– Business Pro users can create service listings, showcase their portfolio, and promote their services through the Businesses section
7.2 RSVPs
– RSVPs are commitments to attend events
– Users can cancel their RSVP if unable to attend
– Users can view the full list of attendees for events they RSVP to
– Event hosts can view all attendees for their events
– Repeated no-shows may result in account restrictions
7A. Digital Garage
7A.1 Car Profiles
– Users can create detailed profiles for their cars in their Digital Garage
– Car information includes make, model, year, specifications, and modifications
– Users can upload multiple photos per car (minimum 5, maximum 20 photos)
– Users can edit car information at any time
– There is no limit to the number of cars you can add to your garage
– Users are responsible for the accuracy of car information posted
– Photos uploaded must be of your own vehicles or used with proper authorization
7A.2 Garage Content
– Garage content is visible to other users based on your privacy settings
– You retain ownership of photos and content you upload
– Tarmac and Toast may feature garage content in community spotlights
7B. Car Clubs
7B.1 Club Membership
– Users can join existing car clubs or create new clubs
– Note: Free tier (Street Pass) users cannot join or create car clubs – upgrade required
– Club founders have administrative privileges for their club
– Club membership may be subject to approval by club founders
– Club founders can customize their club profile (name, description, logo)
– Users can leave clubs at any time
7B.2 Club Responsibilities
– Club founders are responsible for managing their club
– Clubs must comply with Tarmac and Toast’s content and conduct policies
– Tarmac and Toast reserves the right to remove clubs that violate our Terms
8. Intellectual Property
8.1 Our Content
– All content on Tarmac and Toast (logos, design, text, software) is owned by Tarmac and Toast
– You may not copy, modify, or distribute our content without permission
– Tarmac and Toast is a trademark
8.2 Your Content
– You retain ownership of content you post
– By posting content, you grant us a license to use, display, and distribute it on Tarmac and Toast
– You represent that you have the right to post the content
– We may remove content that violates these Terms
9. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
10. Disclaimers and Limitation of Liability
10.1 Service “As Is”
– Tarmac and Toast is provided “as is” without warranties of any kind
– We do not guarantee uninterrupted or error-free service
– We reserve the right to modify or discontinue features at any time
10.2 Limitation of Liability
– Tarmac and Toast is not liable for any indirect, incidental, or consequential damages
– Our total liability is limited to the amount you paid us in the past 12 months
– We are not responsible for:
– User-generated content
– Transactions between users
– Events organized by users
– Third-party services or websites
10.3 Indemnification
– You agree to indemnify Tarmac and Toast against claims arising from your use of the service
– This includes claims related to content you post or transactions you conduct
11. Termination
11.1 By You
– You may stop using Tarmac and Toast at any time
– You may delete your account through app settings
11.2 By Us
– We may suspend or terminate accounts that violate these Terms
– We may terminate accounts that are inactive for extended periods
– We reserve the right to terminate service with or without notice
12. Changes to Terms
– We may update these Terms from time to time
– Material changes will be notified through the app or email
– Continued use after changes constitutes acceptance
– The “Last Updated” date indicates when Terms were last revised
13. Governing Law
These Terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of South Africa.

15. Severability

By using Tarmac and Toast, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
